Borba protiv dopinga

Članak 16.

(1) Sve osobe u sustavu sporta dužne su poštivati pravila nacionalnog tijela nadležnog za borbu protiv dopinga, a osobito vezano uz provedbu testiranja.

(2) Sportaši ne smiju koristiti dopinška sredstva niti metode, u skladu s pravilima Svjetske antidopinške agencije te pripadajućim međunarodnim standardima.

(3) Trener, liječnik i druge osobe ne smiju sportašu davati doping.

(4) Ako se utvrdi da su sportaš ili osoba iz stavka 3. ovoga članka postupali protivno odredbama stavaka 2. i 3. ovoga članka, osoba i nacionalno tijelo nadležno za borbu protiv dopinga koji to utvrde dužni su postupiti sukladno pravilima o antidopingu te pravilima tijela iz stavka 1. ovoga članka.

(1) Novčanom kaznom u iznosu od 700,00 do 3000,00 eura kaznit će se za prekršaj pravna osoba u sportu ako:

– zaključi ugovor sa sportašem suprotno odredbi članka 11. stavaka 1., 2., 3., 5., 6. i 9. ovoga Zakona (članak 11. stavak 1., 2., 3., 5., 6. i 9.)

– dopusti da u sportskom natjecanju sudjeluje osoba kojoj nije utvrđena zdravstvena sposobnost (članak 15.)

– ne poštuje pravila tijela nadležnog za borbu protiv dopinga iz članka 16. stavka 1. ovoga Zakona (članak 16.)

IX. ZDRAVSTVENA ZAŠTITA

Članak 71.

(1) U športskom natjecanju može sudjelovati osoba za koju je u razdoblju od šest mjeseci prije športskog natjecanja utvrđena opća zdravstvena sposobnost, a kada je to propisano pravilnikom koji donosi ministar nadležan za zdravstvo uz suglasnost ministra i posebna zdravstvena sposobnost, ako propisima nacionalnoga športskog saveza nije određeno kraće razdoblje.

(2) Opću i posebnu zdravstvenu sposobnost utvrđuje ovlašteni liječnik-specijalist športske medicine, odnosno specijalist medicine rada i športa. Listu ovlaštenih liječnika utvrđuje ministarstvo nadležno za poslove zdravstva uz suglasnost ministra.

(3) Uvjete za obavljanje zdravstvenih pregleda, vrstu i opseg pregleda, način vođenja evidencije i medicinske dokumentacije športaša te rokove u kojima se provode zdravstveni pregledi za učenike koji sudjeluju u natjecanjima školskih športskih društva, pravilnikom propisuje ministar nadležan za zdravstvo uz prethodno mišljenje ministra.

(4) Obveza utvrđivanja zdravstvene sposobnosti postoji i za druge osobe u športu sukladno odredbama akata nacionalnih športskih saveza.

(5) Opću i posebnu zdravstvenu sposobnost učenika za sudjelovanje na natjecanjima školskih športskih društava utvrđuje nadležan liječnik specijalist školske medicine, odnosno izabrani liječnik specijalist pedijatar ili izabrani liječnik specijalist opće i/ili obiteljske medicine.

ZAKON O SPORTU

Članak 72.

(1) Športaši ne smiju uzimati nedopuštena sredstva (doping) niti smiju primjenjivati postupke koji su nedopušteni prema pravilima Svjetske antidoping agencije (u daljnjem tekstu: WADA).

(2) Trener, ovlašteni liječnik, i druge osobe u športu ne smiju športašu davati nedopuštena sredstva ili od športaša tražiti ili poticati ga da uzima nedopuštena sredstva ili primjenjuje postupke koji su nedopušteni sukladno pravilima WADA-e.

(3) Ako se utvrdi da su športaš ili osoba iz stavka 2. ovoga članka postupali protivno odredbama iz stavka 1. i 2. ovoga članka, osoba i tijelo koji su to utvrdili dužni su postupiti sukladno odredbama WADA-e i Hrvatske agencije za borbu protiv dopinga u športu.

Hrvatska agencija za borbu protiv dopinga u športu Članak 73.

(1) Hrvatska agencija za borbu protiv dopinga u športu (u daljnjem tekstu: Agencija) specijalizirana je ustanova zadužena za praćenje i provođenje međunarodnih konvencija protiv dopinga u športu u Republici Hrvatskoj.

(2) Vlada Republike Hrvatske uredbom osniva Agenciju te utvrđuje ustroj i način njezina rada sukladno Konvenciji o antidopingu u športu.

(3) Djelokrug Agencije čine stručni poslovi:

 1. sustavno praćenje i koordiniranje akcija vladinih i nevladinih organizacija u borbi protiv dopinga u športu,

 2. predlaganje i provođenje mjera u borbi protiv dopinga u športu,

 3. primjene konvencija, kodeksa WADA-e te pravila međunarodnih športskih saveza i Međunarodnoga olimpijskog odbora.

(4) Za svoj stručni rad Agencija je odgovorna ministarstvu.

(5) Sredstva za početak djelovanja Agencije osiguravaju se iz državnog proračuna, a sredstva za njezino trajno djelovanje osiguravaju se iz sredstava za fi nanciranje godišnjeg programa javnih potreba u športu Republike Hrvatske i drugih izvora sukladno zakonu.


The fight against doping

Article 16.

(1) All persons in the sports system are obliged to comply with the rules of the national authority responsible for the fight against doping, especially regarding the implementation of testing.

(2) Athletes may not use doping agents or methods, in accordance with the rules of the World Anti Doping Agency and related international standards.

(3) The coach, doctor and other persons may not administer doping to the athlete.

(4) If it is established that an athlete or a person from paragraph 3 of this article has acted contrary to the provisions of paragraphs 2 and 3 of this article, the person and the national authority responsible for the fight against doping who determine this are obliged to act in accordance with the rules on anti-doping and the rules bodies from paragraph 1 of this article.

(1) A fine in the amount of 700.00 to 3000.00 euros will be imposed for a misdemeanor on a legal entity in sports if:

– concludes a contract with an athlete contrary to the provisions of Article 11, paragraphs 1, 2, 3, 5, 6 and 9 of this Act (Article 11, paragraphs 1, 2, 3, 5, 6 and 9.)

– allow a person whose health capacity has not been determined to participate in a sports competition (Article 15)

– does not respect the rules of the authority responsible for the fight against doping from Article 16, paragraph 1 of this Act (Article 16)

IX. HEALTH CARE

Article 71

(1) A person may participate in a sports competition for which he has been for a period of six months before the sports competition, the general health capacity was determined, and when this is prescribed by the ordinance issued by the minister responsible for health with approval of the Minister and special medical ability, if the regulations of the national sports of the alliance, a shorter period is not specified.

(2) General and special health capacity is determined by an authorized specialist doctor of sports medicine, i.e. a specialist in occupational and sports medicine. List of authorized persons doctor is determined by the ministry responsible for health affairs with consent minister.

(3) Conditions for performing health examinations, type and scope of examinations, method of conducting records and medical documentation of athletes and the deadlines in which they are carried out health examinations for students participating in school sports competitions company, the ordinance is prescribed by the minister responsible for health in addition to the above the opinion of the minister.

(4) The obligation to determine medical fitness also exists for other persons in sports in accordance with the provisions of the acts of the national sports federations.

(5) General and special health ability of students to participate in competitions of school sports clubs is determined by a competent doctor specializing in school medicine, that is, the chosen specialist pediatrician or the chosen general specialist doctor and/or family medicine.

47 LAW ON SPORTS

Article 72.

(1) Athletes may not take or use illegal substances (doping). procedures that are prohibited according to the rules of the World Anti-Doping Agency (in hereinafter: WADA).

(2) The coach, authorized doctor, and other persons in the sport may not give the athlete illegal substances or asking or encouraging athletes to take illegal substances means or applies procedures that are prohibited according to WADA rules.

(3) If it is established that the athlete or the person referred to in paragraph 2 of this article acted contrary according to the provisions of paragraphs 1 and 2 of this article, the person and the body that determined it are obliged are to act in accordance with the provisions of WADA and the Croatian Anti-Corruption Agency doping in sports. Croatian Agency for Combating Doping in Sports

Article 73.

(1) Croatian Agency for Combating Doping in Sports (hereinafter: Agency) is a specialized institution in charge of monitoring and implementing international convention against doping in sports in the Republic of Croatia.

(2) The Government of the Republic of Croatia establishes the Agency by decree and determines its structure and procedure work in accordance with the Convention on Anti-Doping in Sports.

(3) The scope of the Agency consists of professional tasks:

  1. systematic monitoring and coordination of actions of governmental and non-governmental organizations in fight against doping in sports,

  2. proposing and implementing measures in the fight against doping in sports,

  3. application of conventions, WADA code and international sports rules federation and the International Olympic Committee.

(4) The Agency is responsible to the Ministry for its professional work.

(5) Funds for the start of the Agency’s activities are provided from the state budget, and the funds for its permanent operation are provided from financing funds annual program of public needs in sports of the Republic of Croatia and other sources according to the law.
